Welcome to LinguaSwipe. These Terms of Service ("Terms") govern your access to and use of the LinguaSwipe mobile application, website and related services (collectively, the "Service"). Please read them carefully.
1. Acceptance of Terms
By downloading, accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
If you are using the Service on behalf of a minor, you confirm that you are the minor's parent or legal guardian and that you accept these Terms on their behalf.
2. Description of Service
LinguaSwipe is a language learning application that helps users practice vocabulary and improve their language skills. The Service includes, among other features:
- Swipe-based vocabulary flashcards
- A dictionary and personal word lists
- A translator for words and sentences
- An AI-powered conversation tutor
- Pronunciation practice
- Grammar lessons and exercises
The core Service is offered free of charge. Certain features may be offered as optional premium features, subject to payment. Any purchases are processed through the Apple App Store or Google Play and are subject to their respective terms and refund policies. We may add, modify or remove features at any time.
3. User Accounts
To use certain features, you may need to create an account, either by registering with your email address or by signing in with a third-party provider such as Google or Apple. When you create an account, you agree to:
- Provide accurate, current and complete information;
- Keep your login credentials confidential and not share them with others;
- Be responsible for all activity that occurs under your account;
- Notify us promptly at linguaswipe.app@gmail.com of any unauthorized use of your account.
We are not liable for any loss or damage arising from your failure to protect your account credentials.
4. User Content
While using the Service, you may create or submit content such as words you save, word lists, translations you request, and messages you send to the AI tutor ("User Content"). You retain ownership of your User Content.
You grant LinguaSwipe a limited, non-exclusive, royalty-free licence to store, process and display your User Content solely for the purpose of operating, providing and improving the Service. Text you submit for translation or AI conversation may be processed by third-party service providers as described in our Privacy Policy.
You agree not to submit content that is unlawful, offensive, infringes the rights of others, or contains sensitive personal data of third parties. You also agree not to misuse the Service, including by attempting to disrupt it, reverse engineer it, or access it through automated means.
5. Intellectual Property
The Service, including its software, design, logos, the "LinguaSwipe" name, lessons, texts, graphics and other content provided by us (excluding User Content), is owned by LinguaSwipe or its licensors and is protected by copyright, trademark and other intellectual property laws.
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial, educational purposes. You may not copy, modify, distribute, sell or create derivative works from any part of the Service without our prior written consent. Images and translations provided by third parties remain subject to the terms of their respective providers.
6. Disclaimer of Warranties
LinguaSwipe is an educational tool designed to support language learning. It is not a substitute for professional language instruction, certified translation or interpretation services. Translations, definitions, pronunciations and AI-generated responses are produced automatically and may contain errors or inaccuracies. You should not rely on them for legal, medical, financial or other critical purposes.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Service will be uninterrupted, secure or error-free, or that any particular learning outcome will be achieved.
7. Limitation of Liability
To the maximum extent permitted by applicable law, LinguaSwipe and its creators shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of, or inability to use, the Service.
Where liability cannot be excluded, our total liability to you for any claim relating to the Service shall not exceed the amount you paid to us for the Service in the twelve (12) months preceding the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your statutory rights as a consumer.
8. Termination
You may stop using the Service and delete your account at any time from within the app or by contacting us at linguaswipe.app@gmail.com. When your account is deleted, your personal data will be removed as described in our Privacy Policy.
We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties and Limitation of Liability) will continue to apply.
9. Changes to Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where the changes are material, notify you through the app or by email. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
